Terms and Conditions

1. Terminology
These terms and conditions constitute the full and complete service agreement (“The Agreement”) between you (“The Customer “) and the service provider (“The Business”). References to days contained herewith-mean ‘calendar’ days. The Customer is expected to take some time in reviewing this Agreement before using our services and agree to be bound by the terms and conditions set out below.


2. Quotes
It is the customers responsibility to ensure the correct information has been provided regarding the services required and any information which may pertain to the delivery of service.
Estimates provided without inspection are subject to change upon sighting the area.
Quotes are valid for as long as the condition, size or inclusions do not change and is subject to review. 
Email acceptance of the quote or payment is considered binding.
In accepting the quote you have therefore deemed to have accepted these terms and conditions. Quotes are based on the condition of the property at the time of inspection. Any adjustments to the condition will void the quote, following any adjustments a new quote will be provided upon inspection.
All prices quoted are in Australian dollars. GST details are outlined on the quote.

 

3. Timings
All contract timings are subject to weather conditions and/or any unforeseeable circumstances.
The Business accepts no responsibility for any loss of time or otherwise due to timings delays on a contract.
Upon being provided a service date/time the deposit where applicable must be paid to secure this date/time.
The Business reserves the right to cancel if the deposit has not been paid.
It is the Customers responsibility to ensure access to the service areas is available at the date/time of service. Failure to do so may incur additional costs.

 

4. Weather conditions
The Business reserves the right to postpone any contract due to adverse weather conditions. Start dates and project completion are subject to weather conditions. Weather conditions are conditions that are not suitable for the application and/or preparation of services.

 

5. Deposits
A 30% deposit is required to secure the booking or as outlined in the quotation. 10% of this deposit amount is non-refundable under any circumstance. The entire amount is forfeited if the service is cancelled within 48 hours of the start date, unless a reschedule date is agreed on by both parties. 

6. Warranties/Guarantees
The Business uses products that contain product warranties offered by manufacturers in addition to warranties and guarantees implied by law.
All warranties are subject to the property owner carrying out general maintenance on their property to ensure all work carried out is kept to a reasonable standard.
The Business accepts no responsibility for any work carried out that is altered, touched up, tampered with by the property owner or any third party. All warranties are void in this case.
Any warranty claims must be lodged in writing via email as soon as you become aware of a problem. Refer to manufacturer for product warranties.
This limited warranty does not cover:
(1) Peeling, flaking, or blistering resulting from faulty manufacture or formulation of the coating system by the manufacturer;
(2) Any settling, movement, structural cracking or other deterioration of the substrate;
(3) Faulty design or construction of the building;
(4) Any painted surface exposed to extreme conditions such as storm damage or excessive heat; and

(5) Without limitation, any other cause outside our reasonable control.
(6) Painting where the Owner supplies the paint or performs any part of the labour or prep work, this includes; any plastering or painting which is completed prior and/or any treatment or application applied to the walls which have the potential to impact the paint adhesion.
(7) Any cracking, yellowing, water stains, rust, peeling ceilings or previously painted surfaces that have not been sealed.
The liability under this warranty and in respect of any warranty or condition implied by law, will be limited to the following as determined by us;
a. Provision of labour to repair the coating system;
b. Payment of the cost of labour of having the coating system repaired; or

c. Refund of the price paid for labour of applying the coating system

 

7. Products
The Business reserves the right to alter/change products used on any project without prior notice. All products, materials and consumables remain the property of The Business until all balances are paid in full.
The Business reserves the right to remove any product, materials and consumable from site at any time. If for any the reason the customer changes their mind, any associated costs will be incurred by the customer in full.

 

8. Services Requirements
The Customer agrees to ensure access to water and electricity throughout the service.
Where this is not possible the customer agrees to advise the business and incur any costs in obtaining these prior.
The Business does not accept responsibility for any damage caused by any third party during or after the provision of service.


9. Invoices
All invoices must be paid within 48 hours of completion.
The Business reserves the right to request and receive a progress payment during any project.
Any invoice outstanding after 30 days will be handed to a registered debt collector and any costs associated with this process will be passed onto the customer
Outstanding balances after 30 days will incur a 2% interest charge and will continue to incur this interest charge every 30 days after the date of invoice issue until all balances have been paid in full. In addition a $10.00 administration fee per month will be incurred for outstanding invoices each month.
Payment options include direct deposit, bank transfer, PayID or cash.

 

10. Complaints
Any complaints are to be lodged as soon as an issue arises in writing via email. Photo evidence of any complaints is preferred.

 

11. Additional work
Any additional work not stated in the quote will be discussed and agreed upon prior. It is the customers’ responsibility to carefully read and understand the quote issued and inform via email of any discrepancies prior to acceptance.

 

12. Cancellation and Re-scheduling
In order to provide a professional service and to avoid any business disruption caused by no-shows, and short notice cancellations; the minimum cancellation notice period is 7 days. If for any valid reason you require the booking to be adjusted, please email as soon as possible to determine the most suitable accommodation.
The Business reserves the right to cancel or delay a booking at time of service if the service falls outside of the scope of what is reasonably required, is an unsafe working environment, or any factors which we deem unsuitable to obtain the best possible outcome.
Conditions for failure to meet notification periods are listed below:
a) 10% of the total amount is non-refundable. 

b) When customer fails to provide a 48 hour cancellation notice period, the Customer forfeits the deposit amount;
b) If the service is cancelled within the 7 day notice period but not within the 48hrs the Customer forfeits 50% of the deposit with the remaining balance to be returned as soon as possible.

 

13. Inclusions and Exclusions
Quote includes all materials and labour except where stated otherwise.
The Business does not move furniture, personal items and valuables unless agreed to prior.
Any items moved by the Business to gain access at the request of the customer will not be covered for repair or replacement if broken.
